`BTS submits that it has management rights enabling it to impose the criterion according to which an employee is excluded from taking into account a temporary transfer in a benefit management plan. This collective agreement does not contain a “management rights” clause. The provisional agreement was unanimously recommended by the Joint Committee because of the significant improvements in working conditions. “In this case, the parties gave management the right to decide how to temporarily transfer the workers only if the bargaining unit members` work team did not agree on how to do so. Since I have accepted that there is a long-standing practice accepted by the London union, where these are older, qualified volunteers who are temporarily transferred, the employer has not been able to decide how the temporary transfers should be made. . .
